1. Acceptance of Terms

Welcome to ANOQR Market ("ANOQR", "Platform", "We", "Us", or "Our"). These Website & App Terms & Conditions ("Terms") govern your access to and use of our AI-powered digital marketplace, classified listing platform, mobile applications, and related digital services.

By accessing, browsing, registering an account, or publishing listings on ANOQR Market, you ("User", "Seller", "Buyer") agree to be bound by these Terms and our associated Privacy Policy, Seller Terms, and Refund Policy. If you do not agree to all of these Terms, you must immediately cease using our Platform.

2. Business Activity & Intermediary Status

ANOQR operates an AI-powered digital marketplace and online classified listing platform providing users with digital listing, publishing, promotional, and related marketplace services.

ANOQR acts strictly as an online classified publisher and information technology intermediary under Section 79 of the Indian Information Technology Act 2000, EU Digital Services Act (DSA), US Communications Decency Act (Section 230), and equivalent international intermediary protection laws.

ANOQR provides the digital platform for publishing listings. ANOQR does not purchase, sell, own or take title to goods or services advertised by users and does not receive the underlying sale consideration between buyers and sellers.

3. Eligibility & Account Security

To use ANOQR Market, create an account, or publish listings, you represent and warrant that:

• You are at least 18 years of age or the legal age of majority in your jurisdiction.
• You possess the legal authority to enter into binding legal agreements.
• All registration details, contact numbers, email addresses, and verification information provided are accurate, complete, and current.
• You will maintain the security and confidentiality of your credentials and accept sole responsibility for all activities conducted under your account.

4. AI Automated Listing & Security Moderation

ANOQR incorporates artificial intelligence models (including Google Gemini Vision API) to assist sellers with automatic title, description, category, attribute, and price drafting based on uploaded images.

All uploaded images and listing submissions undergo automated AI security scanning to identify and flag policy violations, adult/sexually explicit content, nudity, weapons, illicit items, and counterfeit goods. Non-compliant content will be automatically blocked or deleted.

5. Acceptable Use & Prohibited Activities

Users agree not to engage in any prohibited platform activities, including but not limited to:

• Posting illegal, fraudulent, stolen, counterfeit, hazardous, or restricted items or services.
• Uploading content containing nudity, sexually explicit material, hate speech, harassment, or violence.
• Attempting to bypass security controls, scrape platform data, deploy bots, or disrupt platform infrastructure.
• Misrepresenting item conditions, impersonating another person or entity, or engaging in scam communications.

6. Intellectual Property Rights

All software, source code, AI algorithms, trademarks, logos, brand assets, UI designs, and database structures powering ANOQR Market remain the exclusive intellectual property of ANOQR.

By submitting listing text, photos, and media to ANOQR, you grant ANOQR a worldwide, royalty-free, non-exclusive, sublicensable license to host, display, process, format, index, and promote your content across our platform and digital channels.

7. Limitation of Liability & Indemnity

ANOQR provides the platform on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. ANOQR does not guarantee the accuracy, safety, quality, legality, or availability of user-posted listings.

In no event shall ANOQR, its parent entities, officers, directors, or employees be liable for any indirect, incidental, punitive, or consequential damages arising from user-to-user transactions, listing contents, or platform usage.

You agree to indemnify and hold harmless ANOQR from any claims, losses, liabilities, or legal fees resulting from your violation of these Terms or your interactions with other platform users.

8. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes or legal proceedings arising out of or relating to ANOQR Market shall be subject to the exclusive jurisdiction of the competent courts located in Ernakulam / Kochi, Kerala, India (or applicable regional corporate operating entities for international operations).
